Introduction

The Globe-Trotter website is owned and operated by Globe-Trotter Group Limited (we, us). By using our website and purchasing products from us you agree to be bound by these terms (the Terms) and if you provide your personal data to us, then our privacy policy also applies.

These Terms and the Privacy Policy affect your legal rights and obligations so please read them carefully. If you do not agree to be bound by these Terms, do not use our website. If you have any questions, you can Contact Us.

We reserve the right to update these Terms from time to time at our discretion. We therefore recommend that you review these Terms from time to time and in any event, before every purchase that you make. These Terms affect your legal rights and obligations so please read them carefully. 

Registering an account

You do not need to register an account to view our website or purchase our products.

If you do create an account, you need to provide certain information which we shall process in accordance with the terms of our Privacy Policy. You must register an account in your own name, using your own details, and all information you provide to us on registration must be accurate and complete.

You are responsible for all activities that occur under your account, so please take precautions to protect your account details and contact us immediately or request a change to your password if you believe there has been any unauthorised use of your account.    Do not permit anyone else to use your account details.

We may suspend or delete your account for any reason including if

  • you have breached any provision of these Terms;
  • we cannot verify or authenticate any information you provide to us; and/or
  • we determine that your conduct could damage our reputation.

If we delete your account you must cease to use our website and you may not re-register under a different name.

You may terminate your account at any time on our website, or by by contacting us.

Ordering products

Your order constitutes an offer to purchase products from us, and does not form a binding contract until accepted by us. On receipt of your order, we will send you an order acknowledgement email to the email address provided by you in the order process. This order acknowledgement email will contain your order number and details of the products ordered. This email is an acknowledgement of receipt of your order.  It is not an acceptance by us of any offer to purchase products.

An order shall be accepted by us only when we dispatch the products to you and send you an order dispatch email that includes details of the products, price and payment method. We reserve the right to refuse any order before acceptance and we shall notify you accordingly.

Please ensure that all information in your order is complete and accurate and in particular, you must not use a false name or a known invalid credit card to order products from us. You may only purchase products from us if you are at least 18 years old. 

Price

We must receive payment of the whole of the price for the products that you order and the delivery costs (if any) before your order can be accepted. Payment is to be made by debit or credit card or PayPal. We are not liable for the failure or other acts or omissions of any third party payment system or provider.  

Prices and delivery costs are set out on our website and are subject to change from time to time.

Our Products

Our products are subject to availability. We will inform you as soon as possible if the products ordered are not available and we may offer an alternative product of equal or higher quality and value or provide a refund for sums paid.

However, please note that whilst we try to display the colours of the products accurately, the actual colours you see will depend on your device and we cannot guarantee that your device's display of any colour will accurately reflect the colour of the product on delivery. Accordingly, there may be a slight variance in the size, colour, dimensions, measurements and weight between the products you receive and the description on our website.

Bespoke and Personalised Items

Items that have been personalised or made to order (Bespoke) in-store or online can be neither exchanged nor refunded for reasons outside of our liability.

When ordering a Bespoke or personalised item, it is your responsibility for ensuring the details of your order are correct.

Five Year Warranty

The products on delivery to you shall be of satisfactory quality, comply with their description and fit for their purpose.  Then for five years from the date of delivery, we warrant that the products will remain of satisfactory quality and fit for their purpose. 

If there is any defect in the materials or workmanship of the products on delivery or during the five year warranty period (subject to the exceptions below) then please  Contact Us.  You should also send us appropriate evidence, including photographs, of any defect if we ask you to do so.  We shall repair the defect,  replace the product or refund the price for the product as we reasonably determine.    

The warranty does not apply in the following circumstances:

  • deliberate damage, or reckless misuse;
  • commercial use of the products;
  • inappropriate storage conditions;
  • if you have tried to repair or engaged a third party to try repair the fault
  • fair wear and tear;
  • minor imperfections reflecting the nature of the materials

Delivery

We will use all reasonable endeavours to deliver the products in accordance with the delivery timescale set out on the website.  If you do not receive the products within such timescale, you should notify us accordingly and we shall investigate the delivery. 

Products for delivery outside of the United Kingdom may be subject to additional charges such as import duties and taxes, which are levied once the products reach the specified destination. We have no control over these charges and cannot predict what they may be.  You are responsible for such charges and so we recommend that you contact the local customs office for further information as to the amount of such charges (if any).  Please also note that products for delivery overseas may be opened and inspected by customs authorities.

Right to Cancel 

You may cancel your contract with us for the products by contacting us within 28 days from the date you receive the products, clearly stating the following: your name, geographical address, your phone number,  email address and full details of the order you wish to cancel.

You must take good care of the products (and not use the products) whilst they are in your possession. You must promptly return the products to us (and in any event within 14 days of the notice to cancel). You must return the products using the returns label we provide to you with the original packaging and labels attached to the products. We strongly recommend that you obtain a certificate of posting. Please also make sure you package the products appropriately to avoid damage.   

We will refund any sums paid for the products returned and, if you return the whole (not part) of the order, we will refund the delivery costs you paid (if any) up to the price of standard delivery. We will refund you using the same means of payment that you used to purchase the products.

If you do not return the products that you have cancelled, or you do not pay the costs of returning them to us, or the products are damaged during the course of returning the products or otherwise, we shall be entitled to deduct from the amount to be refunded to you the direct costs of recovering the products or to reflect the loss or damage to the products.

These provisions do not apply to the products which are personalised.

 

Cancellation by us

We reserve the right to cancel your order if:

  • we have insufficient stock to deliver the products you have ordered;
  • we do not deliver products to your delivery address;
  • we cannot obtain authorisation for your payment;
  • we cannot verify that you are aged 18 or over; and/or
  • one or more of the products you ordered was listed at an incorrect price due to a typographical error.

If we do cancel your order we will notify you by e-mail and will refund you all sums paid.  We will not be obliged to offer any additional compensation for disappointment suffered.

 

Use of our website

You may use our website for your own lawful purposes.   

You must not:

  • try to gain unauthorised access to our website or any networks, servers or computer systems connected to our website;
  • use our website in any manner that could damage, disable, overburden or impair our servers or networks or interfere with any other user’s use and enjoyment of our website; and/or
  • except to the extent expressly permitted by law and not capable of exclusion by law, copy, reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble all or part of our website.

We reserve the right to investigate and/or terminate your account if we reasonably believe that you have misused our website or behaved in a way that is inappropriate or unlawful.

You agree that we shall collect and process your personal data in accordance with our Privacy Policy.  In addition, we will collect information about your use of our website.    We may use this information to improve the service offered by our website.

The copyright in all material on our website including all information, data, text, images and software is owned by or licensed to us. All rights are reserved. We have used reasonable endeavours to prepare the content of our website, however, any representations, warranties or conditions of any kind in relation to our website and its content are hereby expressly excluded to the maximum extent permitted by law.

Links and advertisements

Our website may contain links to websites or apps operated by third parties.  We do not have any influence or control over any such third party websites or apps and we are not responsible for and do not endorse any third party websites or apps or their availability or content.

We accept no responsibility for adverts contained within our website. If you agree to purchase goods and/or services from any third party who advertises on our website, you do so at your own risk. The advertiser, and not us, is responsible for such goods and/or services and if you have any questions or complaints in relation to them, you should contact the advertiser.

Availability

We will use reasonable endeavours to make our website available to you at all times.  However, there may be occasions when access to our website may be interrupted, including for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment.  We reserve the right to remove any products, content or features from our website for any reason.

Our website is provided  We cannot promise that we will always find you the safest or lowest risk route because although we monitor conditions in real time, traffic, weather and other factors change quickly and that is beyond our control. 

Our Liability 

We shall have no additional liability to you for any failure to deliver products or any delay in doing so that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Our liability to you shall be limited to loss or damage that is foreseeable result of our breach of these Terms or our failure to take reasonable skill and care. This includes the following:

  • to make good any shortage or non-delivery of the products;
  • to replace any products that do not match the order or are otherwise defective; or
  • to refund to you the amount paid by you for the products in question in whatever way we choose.

We only supply the products for domestic and private use. If you use the products for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity

Nothing in these Terms is intended to limit any rights or remedies that you might have as a consumer under applicable local law or other statutory rights, for fraud, death or personal injury or other loss that may not be excluded or limited by English law.   For further information about your legal rights in the UK, contact your local authority Trading Standards Department or Citizen’s Advice Bureau. 

General

These Terms and the Privacy Policy (as amended from time to time) constitute the entire agreement between you and us concerning your use of our website. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

You consent to receive all communications including notices and other information from us electronically. We may provide all such communications by email, text or by posting them on our website.

If you are based in the EU have any complaint or wish to raise a dispute under these Terms or otherwise in relation to our website please follow this link http://ec.europa.eu/odr

These Terms shall be governed by and construed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English Courts. However, if you are a resident of any other EU member state, you may also bring proceedings in your local courts.
